Tariette is a family-run business inspired by Provence. We take great care in choosing the products we sell, preparing each order and sharing the stories of the artisans and places behind them. We want our Terms & Conditions to be clear and straightforward too.

These Terms & Conditions explain the basis on which Tariette Limited supplies products through www.tariette.com

Please read them carefully before placing an order. By placing an order through our website, you agree to be bound by these Terms & Conditions.

Nothing in these Terms & Conditions affects your statutory rights as a consumer.

2. When these terms apply

These Terms & Conditions apply to orders placed through our website.

If you are purchasing products wholly or mainly for personal use, you are purchasing as a consumer.

If you are purchasing products wholly or mainly for business purposes, you are purchasing as a business customer. References in these Terms & Conditions to consumer cancellation rights and other consumer protections apply only to consumers.

Separate written terms may apply to wholesale orders, corporate gifting projects, bespoke commissions, large-volume orders or other specially negotiated arrangements.

Where separate terms have been agreed in writing, those terms will take priority to the extent that they conflict with these Terms & Conditions.

3. Your eligibility to order

You must be at least 18 years old and legally capable of entering into a binding contract to place an order through our website.

Additional age-verification requirements apply to alcohol, knives and other age-restricted products. These are explained in section 9.

You are responsible for ensuring that the information you provide when placing an order is complete and accurate.

4. Our products and what to expect

4.1 Product descriptions

We take reasonable care to ensure that product descriptions, photographs, measurements, ingredients, allergen information, prices and other information displayed on our website are accurate.

Minor differences may occur between the product shown online and the product received, particularly where products are handmade, hand-finished, naturally produced, artisan-made, vintage or antique.

Colours may appear slightly different depending on photography, lighting and the screen or device used to view the website.

Measurements, weights and capacities are approximate unless expressly stated otherwise.

Nothing in this section affects your rights where a product is materially different from its description.

4.2 Handmade and natural products

Many Tariette products are made by small, independent producers using traditional or small-scale production methods.

Natural variations in colour, shape, texture, glaze, grain, finish, weight or appearance are part of the character of these products and are not necessarily defects.

This may apply to products including handmade pottery, olive wood utensils, soaps, linen, artisan foods and hand-finished cutlery.

These variations are often what make each piece special.

4.3 Vintage, antique and brocante products

Our brocante collection is sourced individually, often during visits to village markets, vide-greniers, antique fairs and specialist dealers in Provence and elsewhere in France.

Vintage, antique and brocante products are pre-owned and may show signs of age, wear, use, restoration or previous repair.

We will describe any significant damage or condition issue of which we are aware. Minor imperfections and signs of previous use that are consistent with the stated age and nature of the product may not be considered faults.

Any estimated date, origin, maker or attribution is provided in good faith, based on the information reasonably available to us.

Vintage or antique items should not be assumed to meet modern manufacturing, electrical, food-safety or safety standards unless we expressly state otherwise.

Products described as decorative should be used for decorative purposes only.

4.4 Food products and allergens

Ingredients, allergen information, storage instructions and other relevant food information are displayed on the applicable product page and provided with the product on its label or packaging.

Recipes, ingredients and packaging can occasionally be updated by a producer. You should always read the label supplied with the product before consuming or serving it, particularly if you or the intended recipient has a food allergy or intolerance.

Please contact us before ordering if you require any additional information about a product or allergen.

Products must be stored and consumed in accordance with the instructions on their packaging. You are responsible for checking any use-by or best-before date and following any refrigeration or storage requirements after opening.

If information on the product label appears to differ materially from the information shown online, please contact us before consuming the product.

4.5 Product packaging

Product packaging, labels and presentation may change from time to time, particularly when our artisan suppliers update their designs or packaging.

Unless packaging is an essential part of the product description, a change in packaging will not normally mean that the product is materially different.

4.6 Hampers and gift boxes

The contents of a hamper or gift box will be listed on its product page.

Occasionally, an individual product may become unavailable after an order has been placed. Where the product page states that substitutions may be made, we may replace an unavailable item with a carefully chosen alternative of equal or greater value.

Any substitute will be selected to complement the original hamper as closely as reasonably possible.

We will not make a material substitution that substantially changes the nature of the hamper without contacting you.

5. Placing an order and formation of the contract

5.1 Checking your order

Our checkout process allows you to review and correct your order before submitting it.

Please check the products, quantities, delivery address, recipient details, gift message and delivery option carefully.

5.2 Order acknowledgement

After you place an order, we will send you an email acknowledging that we have received it.

This acknowledgement does not necessarily mean that we have accepted your order.

5.3 Acceptance of your order

Your order is an offer to purchase products from us.

A contract between you and us is formed when we send you confirmation that your order has been accepted or dispatched.

If we are unable to accept your order after payment has been taken, we will notify you and refund the relevant amount.

5.4 Reasons we may not accept an order

We may be unable to accept an order because:

* A product is unavailable
* We cannot verify your payment
* We cannot verify your age for an age-restricted product
* We cannot deliver the product to your chosen destination
* The product is subject to a purchasing restriction
* There has been an obvious error in the price or product description
* We have reason to suspect fraud, misuse or unlawful activity
* The order exceeds any quantity limit stated on the website
* Accepting the order would breach a legal or regulatory requirement

5.5 Product availability

All products are subject to availability.

This is particularly relevant to seasonal foods, limited-production items and individual vintage or brocante pieces, which may not be replaceable once sold.

If a product becomes unavailable after you place an order, we may offer you:

* A suitable replacement
* The option to wait until the product becomes available
* A refund for the unavailable product
* Cancellation and refund of the affected order

We will not require you to accept a replacement.

5.6 Changing or cancelling an order before dispatch

Please contact us as soon as possible if you need to change or cancel an order.

We will try to accommodate your request, but we cannot guarantee that an order can be changed once it has entered processing or has been dispatched.

Your statutory cancellation rights are explained in section 10.

6. Prices, VAT and payment

6.1 Prices

All consumer prices displayed on our website are inclusive of VAT where VAT is applicable.

Delivery charges are not included in the product price unless expressly stated.

Applicable delivery charges will be clearly displayed before you complete your order.

6.2 International currencies

Prices may be displayed in different currencies depending on your location or the country selected on our website.

Any currency conversion shown on the website may be approximate. The final price and currency charged will be clearly displayed at checkout.

Your card provider or payment provider may apply its own currency-conversion rate or international transaction fee. We do not control these charges.

6.3 Payment methods

Available payment methods are displayed at checkout and may include credit cards, debit cards and third-party payment services.

Payment is subject to authorisation by your card issuer or payment provider.

We may use payment providers and fraud-prevention services to process payments and verify transactions.

6.4 Pricing errors

We take reasonable care to ensure that prices are correct. However, it is possible that a product may occasionally be incorrectly priced.

If the pricing error is obvious and could reasonably have been recognised as an error, we are not required to supply the product at the incorrect price.

Where we identify an error before dispatch, we may contact you to ask whether you wish to proceed at the correct price or cancel the affected product or order.

If we cancel an order after payment has been taken, we will issue a refund.

6.5 Promotions, discount codes and multi-buy offers

Promotions and discount codes are subject to any specific terms displayed with the offer.

Unless expressly stated otherwise:

* Discount codes cannot be exchanged for cash
* Discount codes cannot be applied retrospectively
* Only one discount code may be used per order
* Promotional offers may be withdrawn or amended before an order is placed
* Discounts do not apply to delivery charges
* Certain products may be excluded from an offer

Where an offer depends on purchasing a specified number of products, including a “six for five” or other multi-buy offer, any refund for a partial return will be calculated according to the amount paid and the conditions of the original offer.

A product supplied free as part of an offer does not have a separate cash refund value.

This does not affect your statutory rights where a product is faulty, damaged or not as described.

7. Processing, delivery and risk

7.1 Processing and delivery times

Order-processing time and delivery time are separate.

Our usual processing estimates, delivery services, delivery costs and destination-specific information are explained in our Shipping Policy 

Any delivery date or time provided is an estimate unless we have expressly agreed that it is guaranteed.

We will deliver your order without undue delay and, unless another period has been agreed with you, normally within 30 days after the contract is formed.

7.2 Delivery address

Products will be delivered to the address supplied when you place your order.

You are responsible for checking that the delivery address, postcode, recipient name and contact information are correct.

We are not responsible for delays or failed deliveries caused by incorrect or incomplete information supplied by you.

Where a parcel is returned to us for this reason, we may ask you to pay reasonable redelivery costs.

7.3 Missed deliveries

If nobody is available to accept a delivery, the courier may leave instructions, make another delivery attempt, deliver to an authorised collection point or return the parcel to us.

Age-restricted products may not be left unattended, in a nominated safe place or with a neighbour where the applicable delivery service or law does not permit this.

7.4 Split deliveries

We may send an order in more than one parcel.

You will not be charged additional delivery fees solely because we divide an order into separate parcels.

7.5 Delays

We will try to notify you of any material delay of which we become aware.

If delivery is substantially delayed, you may have the right to cancel the order and receive a refund, particularly where delivery by an agreed date was essential.

7.6 Risk and ownership

Products remain our responsibility until they are delivered to you or to a person identified by you to receive them.

Ownership of the products passes to you when we have received payment in full.

8. International orders, customs and duties

8.1 International availability

We deliver only to the countries and regions available at checkout.

The products available for international delivery may vary according to the destination.

Certain food, drink, alcohol, cutlery, plant-based, animal-derived or other regulated products cannot be sent to some countries.

Alcohol is not available for delivery outside the United Kingdom.

8.2 Delivered Duties Paid orders

Where a Delivered Duties Paid or DDP delivery service is selected and confirmed at checkout, the applicable import duties, taxes and customs charges covered by that service are included in the amount paid to us.

You should not normally be asked to pay those covered charges again upon delivery.

A DDP service may not cover charges arising from inaccurate information supplied by the customer, unusual local fees, storage charges, failed delivery attempts or a breach of the destination country’s import requirements.

8.3 Delivered Duties Unpaid orders

Where a Delivered Duties UnpaidDDUDelivered at Place or similar unpaid-duty service is selected, the recipient is responsible for any import VAT, customs duties, taxes, handling charges or clearance fees imposed by the destination country or courier.

These charges are not controlled by Tariette and are not included in the price paid to us unless expressly stated at checkout.

The recipient may be required to act as the importer and provide information or documentation to customs authorities.

8.4 Customs inspections and delays

International parcels may be opened, inspected or delayed by customs or other authorities.

Customs delays are outside our direct control, although we will provide reasonable assistance where possible.

8.5 Import restrictions

You are responsible for ensuring that the products ordered can lawfully be imported, received and used in the destination country.

If an international parcel is refused, abandoned, destroyed or returned because the recipient did not pay applicable DDU charges, provide requested information or comply with local import requirements, we may deduct any reasonable and unrecoverable delivery, return, customs or disposal costs from a refund, where permitted by law.

This does not apply where the problem was caused by our error or where we should reasonably have identified that the product could not be delivered to the destination.

9. Alcohol, knives and other age-restricted products

9.1 Minimum age

You must be at least 18 years old to purchase alcohol, knives or any other product identified as age-restricted.

It is an offence to purchase an age-restricted product on behalf of someone who is under 18.

9.2 Age verification

We may carry out an age-verification check using an independent verification provider before accepting or dispatching an order.

You may be asked to provide information or identification so that your age can be verified.

If we cannot verify that the purchaser is at least 18, we may cancel the age-restricted part of the order or the entire order.

9.3 Delivery of age-restricted products

Valid photographic identification showing the recipient’s date of birth may be required upon delivery.

Our couriers may operate a Challenge 25 policy. A recipient who appears to be under 25 may be asked to produce suitable identification.

Age-restricted products will not be handed to anyone under 18.

Knife deliveries may require an adult signature and cannot normally be left in a safe place, delivered to a neighbour or delivered to an unattended address.

9.4 Age-restricted gifts

Where an age-restricted product is purchased as a gift, the person receiving the delivery must also be at least 18 and may be required to provide identification.

If appropriate age verification cannot be completed, delivery may be refused and the parcel may be returned to us.

10. Your right to cancel an online order

This section applies where you are purchasing as a consumer.

10.1 The 14-day cancellation period

For most products purchased online, you have the right to change your mind and cancel the contract without giving a reason.

You must tell us that you wish to cancel within 14 days beginning on the day after you, or a person nominated by you, receives the products.

Where products from one order are delivered separately, the cancellation period begins on the day after the final product is received.

10.2 How to cancel

To exercise your right to cancel, you must make a clear statement that you wish to cancel the contract.

You can do this by emailing [hello@tariette.com](mailto:hello@tariette.com) or by using the model cancellation form at the end of these Terms & Conditions.

Please include your name, order number, contact details and details of the product or order you wish to cancel.

You do not have to use the model cancellation form.

10.3 Returning cancelled products

After telling us that you wish to cancel, you must return the products within 14 days.

Unless the products are faulty, damaged, incorrect or not as described, you are responsible for the cost of returning them.

Please return products securely packaged and obtain proof of posting or another form of evidence that the return has been sent.

Please do not return damaged glass, leaking food products or other products that may be unsafe to transport without contacting us first.

10.4 Condition of returned products

You may inspect a product in the same way that you could reasonably inspect it in a shop.

We may reduce a refund to reflect any reduction in value caused by handling beyond what is necessary to establish the product’s nature, characteristics and functioning.

Where possible, products should be returned with their original packaging, labels, accessories and documentation.

The absence of original packaging will not automatically remove your cancellation rights, although damage caused by inadequate return packaging may affect the refund.

10.5 Refund following cancellation

We will refund:

* The price paid for the cancelled products
* The cost of our least expensive standard delivery service, where the entire order is cancelled

If you selected a more expensive or express delivery service, we are not required to refund the difference between that service and our least expensive standard delivery service.

We will normally issue the refund within 14 days after:

* We receive the returned products, or
* You provide satisfactory evidence that you have sent them back, if earlier

If no products were supplied, we will refund you within 14 days after you tell us that you wish to cancel.

Refunds will normally be made using the same payment method used for the original transaction unless expressly agreed otherwise.

10.6 Products for which the right to cancel does not apply

The right to change your mind does not apply, or may cease to apply, to certain products, including:

* Products made to your specifications or clearly personalised
* Products liable to deteriorate or expire rapidly
* Sealed products that are unsuitable for return for health-protection or hygiene reasons once unsealed
* Products that have become inseparably mixed with other items after delivery
* Any other product excluded from the statutory cancellation right by law

The fact that a product is food or drink does not automatically remove the right to cancel.

The exception applies where the particular product is liable to deteriorate or expire rapidly or another statutory exception applies.

These exceptions do not affect your rights where a product is faulty, damaged, unsafe, incorrect or not as described.

11. If something is faulty, damaged or incorrect

Products supplied by us must be as described, of satisfactory quality and fit for their normal purpose.

We carefully prepare and pack every order, but we understand that damage or mistakes can occasionally happen in transit.

If you receive a product that is faulty, damaged, unsafe, incorrect or materially different from its description, please contact us at hello@tariette.com

Please provide your order number and a description of the problem.

Photographs of the product, packaging and delivery label are extremely helpful when investigating damage or arranging a courier claim. However, the absence of a photograph will not by itself remove your statutory rights.

Please retain the product and its packaging until we have advised you what to do, unless retaining it would be unsafe.

Depending on the circumstances and your legal rights, we may offer:

* A replacement
* A repair, where appropriate
* A price reduction
* A full or partial refund

Consumers normally have a 30-day short-term right to reject faulty goods.

For products that are expected to remain usable for less than 30 days, including certain perishable products, the relevant period may be shorter.

Where a product is confirmed to be faulty, damaged, incorrect or not as described, we will bear the reasonable cost of returning it or will make alternative arrangements.

Nothing in these Terms & Conditions limits your rights under the Consumer Rights Act 2015.

12. Refunds

Refunds will be made to the original payment method unless we agree otherwise.

We do not charge an administration fee for a refund required by law.

After we issue a refund, the time taken for it to appear in your account will depend on your bank, card issuer or payment provider.

A refund may be withheld until returned products are received or satisfactory evidence of return is provided, except where the law requires otherwise.

Our Returns & Refunds Policy provides practical information about contacting us and arranging a return.

If there is any conflict between that policy and your statutory rights, your statutory rights will take priority.

13. Gift messages, personalised and bespoke orders

You are responsible for checking any gift message, name, address or personalised information supplied with an order.

We are not responsible for spelling or factual errors contained in information submitted by you.

We may refuse to reproduce a message that is unlawful, threatening, abusive, discriminatory, defamatory or otherwise inappropriate.

Bespoke hampers, personalised products, specially sourced products and corporate gifting orders may be subject to additional lead times, payment terms and cancellation conditions.

Where a product is made to your specifications or clearly personalised, the statutory right to change your mind may not apply.

This does not affect your rights if the product is faulty or does not match the agreed specification.

14. Our website and intellectual property

All intellectual property rights in our website and its content, including text, photographs, product descriptions, illustrations, branding, graphics and design, are owned by or licensed to Tariette Limited.

You may view and print pages from the website for personal, non-commercial use.

You must not copy, reproduce, distribute, republish, sell or commercially exploit our website content without our prior written permission.

You must not misuse our website, knowingly introduce malicious code, attempt to gain unauthorised access or use the website for unlawful purposes.

We may update, suspend or withdraw parts of the website where reasonably necessary.

15. Personal information and payment security

We process personal information in accordance with applicable UK data-protection legislation, including the UK GDPR and the Data Protection Act 2018, as amended from time to time.

Our Privacy Policy explains how and why we collect personal information, how it is used, how long it may be retained, who it may be shared with and the rights available to you.

Payments are processed through secure third-party payment providers. We do not ask you to send complete card details to us by email.

We may carry out fraud-prevention, identity and age-verification checks where reasonably necessary to process an order, comply with the law or protect our customers and our business.

16. Our responsibility to you

We are responsible for losses that are a foreseeable result of our breach of these Terms & Conditions or our failure to use reasonable care and skill.

A loss is foreseeable if it was obvious that it would happen or if both you and we knew that it might happen when the contract was formed.

We are not responsible for losses that are not foreseeable.

Where you are purchasing as a consumer, we supply our products for private and domestic use.

We are not responsible for business losses, including loss of profit, loss of revenue, loss of business, loss of contracts or loss of opportunity.

Nothing in these Terms & Conditions excludes or limits our liability for:

* Death or personal injury caused by our negligence
* Fraud or fraudulent misrepresentation
* Defective products where liability cannot lawfully be excluded
* Breach of your statutory rights
* Any other liability that cannot legally be excluded or limited

17. Events outside our reasonable control

We are not responsible for a failure or delay caused by circumstances outside our reasonable control.

These circumstances may include severe weather, flood, fire, epidemic, pandemic, industrial action, transport disruption, border delays, customs action, war, civil disorder, terrorism, interruption of utilities or communications, government restrictions or failure of a supplier or courier caused by such an event.

Where an event outside our reasonable control affects your order, we will take reasonable steps to minimise the effect and will contact you if there is likely to be a significant delay.

If there is a substantial delay, you may contact us to cancel the affected order and receive a refund for products that you have paid for but not received.

18. Complaints

We hope that you will be delighted with your Tariette order.

If something has not gone as expected, please contact us. We will review the matter carefully and do our best to resolve it fairly and promptly.

19. Changes to these Terms & Conditions

We may update these Terms & Conditions from time to time, including to reflect changes in our business, services, technology or legal obligations.

The Terms & Conditions that apply to your order will normally be those in force when your order is placed.

A later change will not retrospectively alter an existing contract unless the change is required by law or is agreed with you.

20. Transfer, waiver, severability and third-party rights

We may transfer our rights and obligations under a contract to another organisation, provided that this does not reduce your rights.

You may transfer your rights under a contract only with our written agreement, except where the law allows otherwise.

If we do not immediately enforce a right, this does not mean that we have waived it.

If any part of these Terms & Conditions is found to be unlawful or unenforceable, the remaining provisions will continue in effect.

No person other than you and Tariette Limited has any right to enforce a term of the contract, except where the law provides otherwise.

21. Governing law and courts

These Terms & Conditions and contracts formed through our website are governed by English law.

If you live in England or Wales, you may bring legal proceedings in the courts of England and Wales.

If you live in Scotland, you may bring legal proceedings in either the Scottish courts or the courts of England and Wales.

If you live in Northern Ireland, you may bring legal proceedings in either the Northern Irish courts or the courts of England and Wales.

If you live outside the United Kingdom, you may also have the benefit of mandatory consumer-protection laws and rights in your country of residence.

Nothing in these Terms & Conditions is intended to remove rights that cannot lawfully be excluded.
